MORTGAGEE'S NOTICE OF SALE OF REAL ESTATE

By virtue and in execution of the Power of Sale contained in a certain Mortgage given by Bibiana Ramos to Mortgage Electronic Registration Systems, Inc., dated March 8, 2007 and recorded with the Middlesex County (Southern District) Registry of Deeds at Book 49117, Page 478 of which the Mortgage the undersigned is the present holder by assignment for breach of the conditions of said Mortgage and for the purpose of foreclosing same will be sold at Public Auction at 09:00 AM on March 17, 2011 at 64 Clark Street, Framingham, MA, all and singular the premises described in said Mortgage, to wit:

The land and uildings at 64 Clark Street, Framingham, Middlesex County, MA bounded and described as follows:

BEGINNING at a point on the Northeasterly side of Clark Street at corner of land now or formerly of one Fiore; thence running NORTHEASTERLY: by last named land one hundred fifty and 8/10 feet to land now or formerly of John Garbarino; thence NORTHWESTERLY: by last named land and land now or formerly of Peter Capone, sixty-nine and 3/4 feet feet to a corner of land conveyed by Richard M. Everit to Jeramiah Hickey by deed dated May 18, 1885; thence SOUTHWESTERLY: by last named land, one hundred fifty and 8/10 feet to said Clark Street; thence SOUTHEASTERLY: by said Clark Street, sixty-nine and 3/4 feet to the place of beginning.

The premises are conveyed subject to an easement to New England Telephone and Telegraph Company and Boston Edison Company, recorded with the Middlesex South Registry of Deeds, in Book 7433, Page 554.

The premises are subject to and with the benefit of the rights of way of record which are shown on a plan recorded with said Deeds, Plan Book 334, Plan 8 insofar as they affect the granted premises.

For title see deed dated May 30, 2003, recorded with said Deeds, Book 39391, Page 221.

The premises are to be sold subject to and with the benefit of all easements, restrictions, building and zoning laws, unpaid taxes, tax titles, water bills, municipal liens and assessments, rights of tenants and parties in possession.

TERMS OF SALE: A deposit of FIVE THOUSAND DOLLARS AND 00 CENTS ($5,000.00) in the form of a certified check or bank treasurer's check will be required to be delivered at or before the time the bid is offered. The successful bidder will be required to execute a Foreclosure Sale Agreement immediately after the close of the bidding. The balance of the purchase price shall be paid within thirty (30) days from the sale date in the form of a certified check, bank treasurer's check or other check satisfactory to Mortgagee's attorney. The Mortgagee reserves the right to bid at the sale, to reject any and all bids, to continue the sale and to amend the terms of the sale by written or oral announcement made before or during the foreclosure sale. If the sale is set aside for any reason, the Purchaser at the sale shall be entitled only to a return of the deposit paid. The purchaser shall have no further recourse against the Mortgagor, the Mortgagee or the Mortgagee's attorney. The description of the premises contained in said mortgage shall control in the event of an error in this publication. TIME WILL BE OF THE ESSENCE.
